Client agreements come first

If you are a client, your signed agreement with us (such as a Master Services Agreement and Scope of Services) governs the work we do for you, including fees, deliverables and ownership. If that agreement and these terms conflict, your agreement controls.

Using the Services

You may use the Services for lawful purposes and in line with these terms. You must be at least 18, or the age of majority where you live, and if you use the Services for a business, you confirm you are authorized to act for it.

You agree not to:

• Submit a website, business or contact details you are not authorized to submit, or someone else’s personal information without their permission.
• Scrape, copy or harvest the Services or their content by automated means, or try to get around usage limits.
• Attempt to break, overload, probe or gain unauthorized access to the Services or the systems behind them.
• Use James to generate unlawful, harmful or misleading content, or try to make it reveal information it is not meant to share.
• Use the Services to send spam or to build a competing product.

James, our AI assistant

James is an AI assistant. It answers from information we have approved, but AI can still be wrong or incomplete. What James says is general information about JJM Agency and our services, not professional, legal, financial or tax advice, and it is not an offer or a binding commitment. Pricing, contracts and anything specific to your business are confirmed only by our team in writing.

The ROUR Assessment

The ROUR Assessment is free. It is generated with AI from the information you provide and from publicly available information about your business. Scores, findings, estimates and recommendations are opinions to help you think about your marketing. They may contain errors, they are not a guarantee of any result, and you are responsible for decisions you make based on them.

Your report is private by link: anyone with the link can view it, so share it carefully. Reports are available for 12 months. We may limit, decline or remove assessments, for example to prevent abuse.

The JAMES client platform

Platform access is available to clients and people they invite. You are responsible for keeping your login secure and for activity under your account. When you connect a third-party account (such as email, calendar or social media), you authorize us to access it to perform the features you turn on, and your use of that third party remains subject to its own terms. You can disconnect it at any time.

You are responsible for reviewing content before it is published or sent on your behalf, unless your client agreement says otherwise.

Content and intellectual property

The Services, including the website, James, the ROUR Assessment and the JAMES platform, and their design, text, graphics, software and branding, belong to JJM Agency LLC or its licensors. You may view and share pages and your own assessment for your own purposes, but you may not copy, resell or reuse our content or software without written permission.

You keep ownership of what you submit. You give us permission to use it to provide and improve the Services. Ownership of client deliverables is set by your client agreement.

Third-party services and links

The Services link to or rely on third parties, such as Google Calendar for booking and YouTube for video. We are not responsible for their content, availability or practices, and their own terms apply.

Availability and changes

We work to keep the Services available and accurate, but we may change, suspend or discontinue any part of them at any time, and we do not promise they will be uninterrupted or error-free.

Disclaimers

Except as stated in a signed client agreement, the Services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. Marketing results depend on many factors outside our control, and we do not guarantee any particular outcome.

Limitation of liability

To the fullest extent the law allows, JJM Agency LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the free Services. Our total liability for any claim relating to the free Services is limited to one hundred U.S. dollars. Liability for paid client work is governed by your client agreement. Some jurisdictions do not allow these limits, so they may not all apply to you.

Indemnity

You agree to defend and indemnify JJM Agency LLC against claims arising from your misuse of the Services, your breach of these terms, or information you submit that you were not authorized to submit.

Governing law

These terms are governed by the laws of the State of Arizona, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Maricopa County, Arizona, unless your client agreement provides otherwise.

Changes to these terms

We may update these terms from time to time. The date at the top shows the latest revision. Continuing to use the Services after a change means you accept the updated terms.
